A real estate broker is a term in the United States and Canada which describes a party who acts as an intermediary between sellers and buyers of real estate (or real property as it is known elsewhere) and attempts to find sellers who wish to sell and buyers who wish to buy. In the United States, the relationship was originally established by reference to the English common law of agency with the broker having a fiduciary relationship with his clients.

Estate agent is the term used in the United Kingdom to describe a person or organization whose business is to market real estate on behalf of clients, but there are significant differences between the actions and liabilities of brokers and estate agents in each country. Beyond the US, other countries take markedly different approaches to the marketing and selling of real property.

In the US, real estate brokers and their salespersons (commonly called "real estate agents" or, in some states, "brokers") assist sellers in marketing their property and selling it for the highest possible price under the best terms. When acting as a Buyer's agent with a signed agreement (or, in many cases, verbal agreement, although a broker may not be legally entitled to his commission unless the agreement is in writing), they assist buyers by helping them purchase property for the lowest possible price under the best terms. Without a signed agreement, brokers may assist buyers in the acquisition of property but still represent the seller and the seller's interests.

In most jurisdictions in the United States, a person is required to have a license in order to receive remuneration for services rendered as a real estate broker. Unlicensed activity is illegal, but buyers and sellers acting as principals in the sale or purchase of real estate are not required to be licensed. In some states, lawyers are allowed to handle real estate sales for compensation without being licensed as brokers or agents.

Is there a time frame for California real estate broker to return deposit check to the buyer?
Q. if buyer's offer is rejected, the buyer backs out and buyer asks for his/her deposit check back? Do you have a exact link that has a definition or do you have exact source? Because this real estate broker is trying to pospone giving back my deposit check for whatever reason eventhough I keep calling her(she keeps saying she's busy). It's been 3 days since I backed out over the phone & asked to have my check back in person. I told her I can meet her anywhere any time.

In California do you need a real estate broker license in order to be the CEO of a real estate corporation?
Q. This question might be a bit confusing so let me break it down into a couple of questions. 1. I currently run an internet company. Is conducting real estate transactions under this company's name ok or should I set up a seperate corporation? 2. If the better option is to set up a new corporation, should I set up a completely new entity or should I set up a new DBA? 3. Do you need a brokers license in order to be the CEO of a real estate corporation even if you do not intend to hire any agents? 4. If no, do you even NEED a license to form a real estate corporation?

A. 1. In either case the company would need to be licensed. Whether to form another company depends on whether you want the assets of your internet company to be protected from any claims from the real estate portion of your business, and vice versa. 2. See #1. 3. Your company needs a licensed broker. So in order for the company to get a corporate real estate license there needs to be a natural person holding a brokers license who is an officer of your corporation. Doesn't need to be the CEO, but there needs to be someone. I don't think you'll have much luck finding a shill broker who is willing to sign up for you but then not be involved in the business, since their license would be on the line if you screw up 4. See #3.

What are questions I should ask a potential real estate broker-employer?
Q. I just received my real estate salespersons licence in WI. I am now starting the process of finding a broker-employer to sell for. What would be some good questions to ask the potential employer? Also, what would be some good things to look for in a potential employer (i.e. use of companies fax or not, use of a company car)?

A. What you don't know is what kills you in real estate. The broker makes money off you no matter what. Car out of the question. What experience does the broker running that office have? They can make or break you? Look at their resume, no experience means they can't teach you jack. A lot of experience may serve your needs well. There are agents that do and agents that don't. Decide which one you are going to be. If it's the later don't bother interviewing with anyone. Shred your license and call it the day. Let's say your'e red hot, the ink is still wet and you are ready to sell. Work from home get the highest commission split possible and forget about what they are giving you, focus on what you give them so you can negotiate… [cont.]
